INTERESTING TRIAL
As a Result of McIntire-Starr Case, Three of Them are Fined
Last evening the police court was crowded with people to hear the evidence brought out in the Starr-McIntire assault case. A number of people who saw the trouble were in to tell what they knew, and the trial started at 7:30 and continued for several hours.
Thursday Dick Starr, a well known character, rode a pony at the fair, and the trouble started in the afternoon between he and Joe McIntire. The latter was out at the grounds and was drinking. In coming along near the gate where Starr was ready to take his pony on te track, he kicked some dust on the saddle. This started an argument and it ended by Starr striking McIntire in the mouth. Officers were on the scene at one, the trouble was quieted, but not for long. When the races were over and Starr was near the main gate, some one threw a large stone at him, striking the intended mark and laying open the right side of Starr's face. Starr reeled and fell to the ground and it was several moments before he was able to get to his feet.
People who were near the scene at the time, swore that they saw Joe McIntire throw the rock, and that he was accopanied by his brother Cleveland. The injured man came to and had his wound dressed. At about 7:00 that evening he was standing in the Dawley livery barn, talking to Hugh Dawley, when Cleve and Ed McIntire suddenly came upon them and began to throw bricks. They were accompanied by Joe McIntire but it developed that he was not in the trouble at all.
The court fined both Starr and Cleve McIntire a dollar and costs, and Ed McIntire was fiend ten dollars and costs. Joe McIntire was acquitted. All the fines were staid.
The Evening Herald, Montpelier, Indiana; Friday, 6 SEP 1907, p.3 (Ancestry.com):
Dick Starr went over to Bluffton yesterday and entered a plea of guilty to the charges of assault and battery which has been standing against him there for some time and was fined $1 and costs which was paid.

Fence Dispute Results in Killing
C. C. Starr, of near Bernie, was fatally shot Sunday night about 7 o'clock which resulted in his death early Wednesday morning, from a dispute over the fencing of a neighborhood road west of Bernie.
Pone Brook (sic), Lem Parker and Vernie Higginbotham were arrested Monday as implicated in the affair and released on a $200 bond each after appearing before 'Squire Nichols.
It seems that Starr fenced up a road through his land after it had been agreed by him to be left open for neighborhood convenience. The fence upon several different occasions was torn down, and upon the third rebuilding Starr announced that anyone who undertook to tear down the fence would be hurt, as he was going to watch it.
Sunday evening he left home with a Winchester rifle and shotgun. About 7 o'clock several shots were heard in the vicinity of the fence and Starr was later found with a gunshot wound in his right side. He was able to reach his home with the assistance of his family and make a statement to Deputy James A. Walker of Bernie, which caused the arrest of the three men, but rapidly weakened until his death Wednesday morning. --Bloomfield Vindicator.

STARR MURDER SUSPECTS TAKEN TO BLUFF
The three men: Pone Brock, Lem Parker and Vernie Higganbotham -- suspected of C. C. Starr's murder, were taken to Poplar Bluff Wednesday by Sheriff George Barham.
Their preliminary trial was set for Tuesday, to be tried before 'Squire Nichols of Bernie, but for reasons of his own, Prosecuting Attorney John Hodeg had the trial changed to Dexter before 'Squire Crain. Edmundson, the lawyer for the defense, put out a change of venue petition to get the trial back to Bernie and in order to defeat this, Hodge had the three men taken to the Bluff for imprisonment.
The case has been arraigned before Judge Crosser of this place for the preliminary trial now.
He was buried in April 1914 at Grove Cemetery, Wells Co., IN.
