John Boone was elected High Sheriff of the large expansion of territory, known as Burke County for two terms, 1832-1833 and again in 1836-1837. State law would not permit a Sheriff to succeed himself in office at that time, so one term had to elapse before he could be elected. He was a respected and loved man, with a kindly and compassionate nature, but being a public servant he was required to carry out the orders of the court, which, on one occasion, including the hanging of Frankie Silvers, his wife's niece. Kincaid family history tells of this incident, saying, that John Boone was so grief stricken that tears flowed freely down both of his cheeks. It was said that from that day on his health declined, and he died in his last term in office. John Boone married Isabella Kincaid, daughter of Robert Kincaid and Margaret Dunn, on 27 August 1818 at Burke Co., NC. John Boone died on 22 November 1837 at Burnsville, Yancey Co., NC, at age 48. He was buried in November 1837 at Kincaid Cemetery, Lenoir, Caldwell Co., NC.
