City man bound to jury on sexual battery charge (By Sandy Hodson, Press Staff Writer)
A Johnson City man was bound to a grand jury Thursday from Sessions Court on a charge of aggravated sexual battery.
The assault charge against Robert L. Garland, 38, 2915 Chatham Drive, warranted "aggravated" circumstance because the incident involved an 11-year-old boy, Assistant District Attorney General Teresa Murray argued.
Garland was arrested Aug. 26 and charged with aggravated sexual battery after the then 10-year-old boy told his parents and police that Garland had fondled him earlier that month while the two hunted mushrooms in a field behind the boy's home.
During the preliminary hearing, the alleged victim testified Garland had come to his house on a Saturday morning in early August. While his younger brother wandered off a distance to watch another youth ride his motorcycle, the boy testified, Garland sat down and pulled the boy onto his lap. The boy said Garland then fondled him inside and outside his clothing.
The boy testified he did not tell anyone immediately about the incident because he was too frightened. He also said Garland had warned him several months before that if he told anyone, he (Garland) would go to jail.
The sixth-grade student also testified Garland's actions that day were "the same old thing."
During the hearing, defense attorney James Nidiffer made a motion to dismiss the case because "it had been tainted".
Because of courtroom equipment failure, Sessions Court Judge Stewart Cannon recessed the hearing, admonishing the witnesses not to discuss the case.
When the boy's testimony continued, he said he and his mother had talked about the alleged incident's date, Aug. 3 or 10.
Cannon ruled the discussion was not grounds for dismissal.

Telford man held in fatal collision
JONESBOROUGH - A Washington County man has been arrested on vehicular homicide charges in connection with a Sunday morning accident that killed two Jonesborough men.
A spokeswoman for the Tennessee Highway Patrol said 33-year-old Kevin Cloyd of Telford faces two counts of vehicular homicide and one count of possession of schedule drugs for resale.
The charges stem from a 12:15 a.m. accident on old state Route 34, four miles south of Jonesborough. The THP spokeswoman said the accident occurred when a pickup truck driven by Cloyd allegedly crossed the center line of the two-lane highway, and struck an oncoming car driven by 26-year-old Paul R. Lehew of Jonesborough.
The police spokeswoman said Lehew and a passenger in his car, 23-year-old Charles Garland of Jonesborough, were both killed. Cloyd, who suffered only minor injuries, remained in the Washington County Jail Sunday night without bond on the homicide charges, and in lieu of $25,000 bond on the drug charge. He is scheduled to appear in Washington County General Sessions Court Tuesday for a bond hearing.
