Biography

Cleo Claude DaVault was born on 5 March 1907 in Pratt Co. (probably), KS. He married Alice Katherine Kuntz; no record found of either this marriage or the subsequent divorce -- there may or may not have been a legal marriage or divorce. Both Cleo and Alice were listed on the March 1925 Kansas state census, unmarried and living in their respective parents' households. Alice was listed on the 1930 federal census, Fairview, Oklahoma, marital status "D". Cleo is not clearly listed on the 1930 census, but I believe the 23 year-old man indexed as "Crew" with a scratched out surname, and single, listed on the 1930 census of Pratt, Kansas, was in fact Cleo Davault. The birth location of his mother is incorrectly shown as Illinois, but that may have been an erroneous belief by him or another person who gave the information. DLB 2023.1,2 He and Alice Katherine Kuntz were divorced before April 1930. He married Irene Ruth Long. He died on 25 May 1989 in Pratt, Pratt Co., KS,

Told Truth; 'Drugs' Just Vitamin Pills

County Attorney Porter Brown has dismissed a felony drug complaint after he learned the defendant had told the truth at his arraignment in magistrate court.

Dace DaVault, 22, who gave his address as Americus, told Judge Elmer Goering in December that the capsules he was accused of selling weren't amphetamines as alleged in the complaint.

Tested in Lab

"They're only vitamin pills," DaVault was quoted as saying.

Brown said the capsules did in fact turn out to be vitamin pills. Results of an analysis at the Kansas Bureau of Investigation laboratory were learned some time after the arraignment.

The county attorney said DaVault had been told by a friend that passing off vitamin pills for drugs was an easy way to make money. The selling price was $1 a capsule, he said.

Sold 200 Capsules

DaVault was arrested in December after he sold 200 capsules to an undercover agent in a pre-arranged location in Hutchinson.

Sheriff's officers waited outside the location and entered on a signal pre-arranged with the undercover agent.

Brown said he decided against filing a fraud charge against DaVault.

DLB 2023.1,2 Alice Katherine Kuntz and Cleo Claude DaVault were divorced before April 1930. She married Ora Edgar Hays, Jr., on 2 July 1942 in Vancouver, Clark Co., WA; ceremony by Rev. Paul L. Kunzman of Vancouver. Alice was still using the Hamilton surname, and indicated she was divorced on the license application. She died on 26 December 1988 in Portland, Multhomah Co., OR. She was buried in Riverview Abbey Mausoleum and Crematory, Portland, Multnomah Co., OR, Findagrave #198014933.
Alice Katherine Kuntz lived on 18 April 1930 in Fairview, Major Co., OK.1 She lived on 1 April 1935 in Fairview (rural), Major Co., OK.3 She lived on 16 April 1940 in Fairview, Major Co., OK.3 She lived on 8 April 1950 in Southern Pacific Railroad Tracks, Albany, Linn Co., OR.4
