Told Truth; 'Drugs' Just Vitamin Pills
County Attorney Porter Brown has dismissed a felony drug complaint after he learned the defendant had told the truth at his arraignment in magistrate court.
Dace DaVault, 22, who gave his address as Americus, told Judge Elmer Goering in December that the capsules he was accused of selling weren't amphetamines as alleged in the complaint.
Tested in Lab
"They're only vitamin pills," DaVault was quoted as saying.
Brown said the capsules did in fact turn out to be vitamin pills. Results of an analysis at the Kansas Bureau of Investigation laboratory were learned some time after the arraignment.
The county attorney said DaVault had been told by a friend that passing off vitamin pills for drugs was an easy way to make money. The selling price was $1 a capsule, he said.
Sold 200 Capsules
DaVault was arrested in December after he sold 200 capsules to an undercover agent in a pre-arranged location in Hutchinson.
Sheriff's officers waited outside the location and entered on a signal pre-arranged with the undercover agent.
Brown said he decided against filing a fraud charge against DaVault.
