Given his 1870 location in Kansas, it seems most unlikely that this was the same individual. DLB 2012.

Surety was Henry Surber. Guardianship appointment dated 15 June 1857. (Highland County probate records, p.205.) He died in 1870 in White Oak Twp., Highland Co., OH, David King is shown in the 1870 census, living in the household of William Lance as of the first day of June. However, he made an informal will in January of 1870, which was proven in court in March, 1871, which provided for headstones for his own grave and that of his mother and a half-brother named James A. King. (page 99 of Highland County probate listings.)
